NEW WINDSOR - A convicted sex offender was charged with third-degree criminal trespass after he went through the gate of a playground on Tuesday and attempted to make contact with children and teachers, according to police.
Mark Nelson, 61, of Newburgh, trespassed in a fenced-in playground of a nursery school and approached two children and two employees when they exited the school around 7 p.m., New Windsor police said in a news release on Thursday.
He sat in a dark area, yelled “hello” and tried to get them to engage in a conversation, police said The women and children then fled the area and retreated to their vehicle.
Nelson is a level 3 sex offender, the most dangerous level. He was arrested by the Middletown City Police Department in 1996 for coerced sexual contact. He was convicted of first-degree attempted sodomy with two children, ages 10 and 11, and sentenced to three to six years in state prison.
He was issued an order of protection and released without bail on the latest New Windsor charge. He will return to court on March 10.
